ASBESTOS SURFACING TREATMENT CLASS ACTION

Welcome to asbestosclaimsc.com

This site is devoted to the administration of two class action settlements which seek to partially reimburse South Carolina `building owners for past and future costs associated with the abatement of asbestos-containing surfacing materials.

The underlying lawsuit was filed by Anderson Memorial Hospital through its counsel, Speights & Runyan. In 2001, the South Carolina Circuit Court certified a class action on behalf of South Carolina building owners whose property contained or previously contained asbestos-containing surfacing materials, including but not limited to the owners of private residences, commercial buildings, and county and municipal government buildings. The Court excluded only five categories of buildings from the certified class action: any building owned by the state government and subject to a prior lawsuit; any building owned by the federal government; any commercial building leased to the federal government after May 30, 1986, any public or private elementary or secondary school which did not opt out of the nationwide schools class action; and any public or private college or university which did not opt out of the nationwide universities class action.

Shortly after the certification of the class action, all of the active defendants declared bankruptcy. The present settlements were negotiated and reached with two of the defendants as a part of the bankruptcy process.

Attached you will find a legal notice and claim form. If you believe you may be in the class and eligible for reimbursement, please submit the form and someone will be in contact with you shortly.
